Please be advised that the Confederated Tribes and Bands of the Yakama Natin will move for leave to intervene as a defendant in the above named action to assert the defenses and counterclaim set out in its proposed answer and counterclaim in intervention, a copy of which is attached hereto as Exhibit A.

The grounds for this mortion are set out in a memorandum in support of the motion to intervene, a copy of which is attached hereto in Exhibit B.

The motion will be based on tis notice and on all the pleadings, papers, and records filed in this action.
